An employee of your final project business photographs a celebrity in your store. What do you do?


All, individuals in most states have the right of publicity,  Nevertheless, civil liability may come into play if the photo is used in a manner of advertising without their consent. This leaves both the person who took the photo and the business liable for lawsuit if the individual who was in the photo felt it was an invasion of privacy, or deception of the character in a negative manner.

At our property The Peninsula Chicago we make it our highest priority of safety and assurance of  privacy for our guests. We have rules in place for our employees that they cannot under any circumstances take a picture with a celebrity or person in the property while working for the Peninsula Chicago. The employee will be met with disciplinary actions them.

We would give the employee a written warning and also delete the photo taken. Termination can also be taken if we found the cause to be to great.  The second time this scenario happens we will terminate the employee indefinitely.  Since the photo was taken in the hotel, we have the right to privacy as property owners and we may restrict and limit any and all photographs and videos on private property.

How will you make sure you advertise your product or service with true statements?

Guest satisfaction and loyalty is a top priority at our establishment. We want our guests to feel welcome and at home when they stay at our property. There is a reason they choose our hotel over others and they expect a certain standard. That's why at the Peninsula we have created our own standards that have made us a five-star hotel. We cannot cheat or mislead our guests in anyway. Our guests expect a certain type of cachet when choosing our property. When creating advertisements they intended to be in a perspective of our guest. That is why it is important when advertising showing guests true experiences of all of our amenities, features and unique opportunities that are available in our property. Our potential guests have to have an idea of what they will experience when they join us at our property.



They can see this by watching our visual advertisements on multiple platforms including YouTube, FaceBook and Instagram. In these videos it gives our guests views from all around the city giving them an idea of what to expect. Then we get to show off our amenities, if potential guests want to learn more about them they can either contact our support team or log onto our website and receive full descriptions of each of them.

Our team has to be cautious about advertising,  as every person understands and conceives information differently. This can lead to potential problems by our guests consequently being mistaken for what the experience may really be like. We have to make sure that we avoid misleading and confusing our guests, and illustrate only what we actually provide and do.  The most important thing we do is exceeding our guest expectations by advertising only what they will meet with in reality.
